PRIVACY AND PERSONAL DATA PROTECTION POLICY

Effective as of March 1, 2020

This Policy describes how the CultFood project website collects, uses, and discloses information, as well as the options available to visitors of https://cultfood.info regarding such information.

The Policy encompasses the services offered by the CultFood project website, including but not limited to (hereinafter collectively referred to as the "Website"):

This Policy has been developed in accordance with the requirements of Ukrainian legislation as well as the provisions of European directives and regulations concerning the protection of personal data, as the services of the CultFood project website (hereinafter referred to as the "Company") are publicly accessible to both Ukrainian citizens and citizens of the European Union.

This Policy has been designed to be accessible, comprehensible, and transparent. To ensure clarity, it has been divided into the following sections, and defined terms are introduced in capital letters.

Application of the Policy

This Policy applies to visitors of the Website, who may access and review information available on the Website, register on the Website using social media, and share content from the Website on social networks, thereby granting the Company access to their IP address.

It should be noted that Website services may occasionally direct visitors to services of third-party companies, such as Facebook and Twitter "like" and "share" functionalities, which may collect anonymized data (hereinafter referred to as "Third Parties"). These Third Parties have their own privacy and personal data protection policies. Therefore, visitors should be aware that any information shared with such Third Parties is governed by their respective policies.

The Company is the controller and processor of personal data collected from Website visitors.

Information Collected and Received from Visitors

Visitors of the Website may browse its content, interact with each other and with representatives of the Company by leaving comments on the Website and sharing information from the Website on social networks. These actions grant the Company access to:

  • The visitor’s IP address;
  • Data provided by the visitor during Website registration (if registration is completed via existing social media accounts, this may include name, surname, email address, etc.);
  • Cookies.

Additionally, the Company collects information regarding Website visits, such as date and time of access, visitor's browser type, etc.

The Company does not collect or process any sensitive personal data, including but not limited to racial, ethnic, or national origin, political, religious, or philosophical beliefs, sexual orientation, or genetic data.

How Information is Used, Shared, and Disclosed

Like most websites, the Company collaborates with services such as Google Analytics, Facebook API, and Google Tag Manager. These services analyze visitor preferences for targeted advertising purposes. The Company shares only anonymized visitor data with these services, ensuring that no personally identifiable information is disclosed.

Upon accessing the Website, session cookies (small files) are stored on visitors' hard drives. These temporary cookies remain active only during the Website session. A "cookie" is a small data file recorded on a visitor’s computer to facilitate Website use. These files track visit frequency and duration.

IP addresses are used in this process but are processed anonymously. No personal data analysis is conducted. Visitors can configure their browsers to automatically delete all or specific cookies upon closing. They may also refuse cookies entirely or browse in private mode to prevent data collection.

Information Security

The Company prioritizes personal data protection. Information shared by visitors is safeguarded using appropriate technical, organizational, and administrative measures to prevent loss, unauthorized access, dissemination, or disclosure. Access to visitor information is granted only to employees who require it to fulfill their job responsibilities.

However, despite the Company’s efforts, absolute protection against external threats cannot be guaranteed.

Protection of Minors' Personal Data

Children require special protection concerning personal data, as they may be less aware of risks, consequences, and safeguards. Since the Company’s content may have certain viewing restrictions for minors, and the Website is not exclusively intended for underage users, the Company urges parents to educate their children on internet safety and the necessity of using the Website’s services responsibly.

Amendments to the Policy

The Company reserves the right to amend this Policy from time to time. Legislative, regulatory, and industry standards may evolve, necessitating changes to this Policy. In the event of amendments, the updated version of the Policy will be uploaded to the Website, indicating the date of the latest revision. If a visitor disagrees with the Policy, they have the right to refrain from using the Website, in addition to other rights outlined in the following section.

Visitors' Rights

Given the unrestricted territorial access to the Website and compliance with the General Data Protection Regulation (GDPR) concerning the processing of personal data of European Union citizens, the Company provides a list of rights for Website visitors who are residents of Ukraine and the European Union:

7.1. Rights of Website Visitors under the Law of Ukraine "On Personal Data Protection":

  • To know the sources, location, and purpose of their personal data processing, as well as the location or residence (stay) of the controller or processor, or to authorize representatives to obtain such information, except as provided by law;
  • To obtain information on conditions of access to personal data, including information on Third Parties to whom personal data is disclosed;
  • To access their personal data;
  • To receive, no later than thirty calendar days from the date of request, confirmation on whether their personal data is being processed and to receive the content of such personal data, except as provided by law;
  • To submit a reasoned request objecting to the processing of their personal data;
  • To request the rectification or deletion of personal data that is unlawfully processed or inaccurate;
  • To protect their personal data from unlawful processing and accidental loss, destruction, damage, concealment, failure to provide, or untimely provision, as well as from providing false information that affects an individual’s honor, dignity, and business reputation;
  • To file complaints regarding personal data processing with the relevant authorities or courts;
  • To apply legal remedies in case of personal data protection violations;
  • To impose restrictions on data processing rights when providing consent;
  • To withdraw consent for personal data processing;
  • To know the mechanism of automatic data processing.

This Policy aims to ensure transparency, compliance with applicable laws, and protection of visitors' personal data.
